Studio Policies

All clients are asked to arrive 5 minutes prior to session. A $25 late fee will be assessed if you are between 10-20 minutes late. If you are more than 20 minutes late, the session will be cancelled and session fee is non refundable and non transferable.

Sessions may be rescheduled by the client once, otherwise the retainer fee will be forfeited.

A 50% non-refundable, non-transferable retainer is due at the time of booking, session balance is due 10 days prior to session.

A $50 rescheduling fee is assessed if session is rescheduled after 15 minutes up to 29 minutes of session start. Fee not applicable if session is cancelled due to weather or photographer canceling. This being said, Photographer can not be held responsible for weather. If weather is not acceptable to client, but not a cause to reschedule, all standard rescheduling fees apply otherwise session fee is forfeited as a cancellation. Sessions can be rescheduled by phone, text message or email prior to session date. Rescheduling must be done by phone, or text message on day of session. Incase of rain or poor weather, the studio reserves the right to postpone the session.

Shani Studios, being a completely archival studio that believes in the printed product, therefore we do not sell digital images, under any circumstances

Being that photography is an artistic process which is the representation of the client by the artist, Shani Studios, will never, under any circumstance release RAW images, unedited images or full un-culled catalogs to any client.

No personal cameras/cell phones will be permitted during the session.

We reserve the right to terminate a session immediately in the event that you are uncooperative, disruptive or abusive to us or any of our employees or contractors In the event that we terminate the agreement under this clause your session fee will be forfeit.

If subjects are unwilling or uncooperative photographer will not be held responsible. I will do my best to capture your child’s personality whether it be posed or unposed moments. However it is the ultimately the parents responsibility to keep your children under control during the session. If the session is stopped due to this reason, there will be no refunds. If  I feel that a gallery cannot be built out of any of the shots taken during the session, I reserve the sole right to decide if the session will be rescheduled. The reason for no refund is because this spot was reserved for you and you alone. Therefore, I am unable to book any other appointments during the time you reserved. In the case that you will need to re-book due to an uncooperative child, and the session was not decided for rescheduling by me, there will also be the standard $35 rescheduling fee.

Prices are subject to change without notice. Pricing provided at the time of booking is valid for one month following the session.

To make room for new clients, all unordered images will be purged from our system immediately following your ordering session.

Travel fee may apply to sessions outside of the Contra Costa County Area, California

Clients will be given the option to work with the photographer for a one time sales consultation at any time or a 14-day online catalog to choose their photos on their own. Only ONE in person booking is available per client. Clients who choose online gallery review will have 14 days to submit their favorite images and/or orders, this ensures all clients are provided the best quality of service in a timely manner.

Due to the custom nature of portraits all orders are paid in full during the ordering appointment and all orders are final. $100 minimum for all print orders.

All pricing is subject to 9% sales tax. Cash, Credit Card, or Personal Check accepted.

Gift cards and certificates are available for purchase.

All Photographs taken by Shani Studios, Kathryn Girtler or her associates are the studios property, will remain her/her associates property and are protected by United States Copyright Laws (USC Title 17). We will retain all intellectual property rights (including copyright) in the photographs and other materials delivered to you. We will be free to edit and enhance the photographs as we see fit (but we agree not to edit or modify any photograph in a derogatory or offensive manner).The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. From time to time we may also license photographs for commercial use. However we will inform you before displaying or licensing any photograph of a child who is under 18 years old and if you object on reasonable grounds we will not proceed with the display, publication or licensing. Client hereby waives any claim for ownership, income, editorial control and use of the images. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. All images are copyrighted by Kathryn Girtler of Shani Studios. I retain ALL copyrights to my photographs/files. When purchasing a thumb drive or receiving digital media from a print purchase, you receive PRINTING rights, not the copyrights. Upon payment of our fees in full you will be granted a license for personal and family use of the photographs. This license does not include any commercial use of the photographs for which an additional fee will be payable.  My photos are not to be altered or edited in ANY way. Photography is art. You don’t buy a painting and paint over it. Please respect my art. Thank You.
